How I run the operation. These Terms apply to any booking made through curtisbutcher.com and to use of the site itself.

The detail around any specific booking - what the fee covers, what happens if you reschedule, what I need from the venue, day-of policies - lives on the Booking Info Page or the quote you receive. That document is the operating contract for your booking. Paying the booking fee confirms you've read and accepted what's on it. These Terms cover the legal frame around all of that.

The operator

I'm Curtis Butcher, sole trader, based in Perth, Western Australia. ABN: 36 712 236 216. I provide entertainment, hosting, and related creative services. The specific scope and pricing for each booking is set out in the relevant offer page, quote, or Booking Info Page at the time you book.

Booking and payment

Bookings are secured by a non-refundable booking fee. The amount, inclusions, and payment schedule for any specific booking are set out on the relevant offer page, quote, or Booking Info Page at the time you book.

Paying the booking fee locks the date - that date comes off my calendar. The fee isn't a deposit in the colloquial sense; it's the price of the calendar lock, and the calendar-lock service is delivered the moment payment clears.

Any balance owed is invoiced separately and due as stated on the Booking Info Page or quote. If the balance isn't paid by the event date, I don't show up. This is policy, not a negotiating position.

Payments are processed by third-party payment providers. By completing payment, you accept these Terms and the relevant Booking Info Page or quote as the binding terms for your booking.

Cancellation and rescheduling

If you cancel, the booking fee stays with the original date. The calendar slot was off the market from the day you paid - the service was already delivered.

If you reschedule and the new date is available, the booking fee transfers across. If the new date isn't available, the original fee doesn't refund and a new booking fee applies to the new date.

If I can't attend due to serious illness or genuine emergency, you get either a substitute provider from my vetted network or a full refund of all fees paid. Your call.

If I terminate service during an event for safety reasons, harassment, an unsafe environment the venue won't address, or unpaid balance, no refund applies. The bar for triggering termination is genuinely high. Full conditions are on the Booking Info Page.

Discretion and creative output

How the work gets delivered on the night is my call, within the scope you've booked. Song selection, set lengths, crowd response, the feel of the room - all depend on real-time conditions and can't be promised in advance. The scope I commit to is on your Booking Info Page or quote. The judgement calls inside that scope are mine.

Liability

I carry public liability insurance covering my operations. If my equipment is damaged at your event, that's between me and my insurer. You're never on the hook for my gear.

To the extent permitted by law, my total liability for any single booking is capped at the fees paid for that booking. The non-excludable consumer guarantees under Australian Consumer Law still apply, and nothing in these Terms tries to override them.

I don't accept liability for matters outside my reasonable control: venue equipment failures, power outages, weather, third-party vendor issues, government restrictions, or other force majeure events. Where any of these affect the night, I work the problem with you in real time rather than walking out.

Governing law

These Terms are governed by the laws of Western Australia. Any dispute that can't be resolved between us goes to the courts of Western Australia.

Changes

If these Terms change after you've booked, the version live on the date of your booking is the version that applies to that booking. Prior versions stay on file.
